On 3 August 2023, HMCTS issued updated ET1 claim and ET3 response forms for use in employment tribunal proceedings.
Both forms now allow a claimant or respondent to give an alternative designation other than Mr, Mrs, Miss or Ms for their title. On the ET1, a claimant may ‘prefer not to say’ as an alternative to identifying themselves as male or female.
There are now separate boxes for the parties to indicate whether they can take part in video or telephone hearings. If a claimant indicates that they can take part in neither, they will need to explain why.
There is now a specific box to tick for whistleblowing claims in the ‘type and details of claim’ section.
