We wondered, idly and apropos of nothing, what in data protection terms might permit disclosing to the media CCTV footage revealing an illicit (and, in the context of lockdown, possibly illegal) affair between a Government minister and an aide. Though all sorts of other potential issues might arise, in data protection terms it would probably be OK: even though it’s special category processing, it looks very much like para 13 of Schedule 1 of the Act would apply, on processing for journalism and other special purposes in connection with unlawful acts and dishonesty etc. If anyone reading this email is particularly affected by this purely hypothetical exercise, our fees are very reasonable.
