5 Essex Chambers Inquests Authorities Index – November 2023 Edition

We are delighted to share with you the latest version of our Inquests Authorities Index. Please discard previous versions. The index contains a list of the most commonly cited inquests authorities, grouped by category. In the next edition, we plan to add a new section on section 13 applications. Meanwhile, please do let us know if you have any feedback or suggestions.

• Non-causative factors, and the causes of mental deterioration in suicide cases, in Jamieson inquests; the purpose of inquests.
• Dillon, R (On the Application Of) v HM Assistant Coroner for Rutland and North Leicestershire [2022] EWHC 3186 (KB) (Admin)
• PFDs and resource implications.
• R (on the application of Police Officer B50) v His Majesty’s Assistant Coroner for the East Riding of Yorkshire and Kingston upon Hull [2023] EWHC 81 (Admin); [2023] Crim. L.R. 419
• The correct application of the Galbraith plus test.
• Although Morahan was (unsuccessfully) appealed to the Court of Appeal, we have retained the divisional court judgment as Popplewell LJ’s detailed analysis of Article 2 is helpful and was approved not only by the Court of Appeal, but by Lord Sales in Maguire.
