The jury trial – Boxill v (1) Commissioner of Police for Metropolis (2) Serco Ltd – at Central London County Court before HHJ Saggerson, related to two arrests of the claimant, carried out by police officers acting on information about a breach of bail provided by Serco (who operated electronic monitoring equipment at the time). The claimant sought to argue that Serco 'procured' the arrests.
The claims against both defendants were dismissed. Costs orders were made in their favour.
Robert Talalay was instructed on behalf of the Commissioner of Police for the Metropolis and Alex Ustych was instructed on behalf of Serco Ltd. Both Robert and Alex have extensive experience of acting on behalf of police forces and other organisations in claims for false imprisonment, malicious prosecution and other civil actions.
