The Divisional Court (Lord Justice Flaux and Mr Justice Saini) held the first hearing today in the claim for judicial review brought by the parents of Harry Dunn against the Secretary of State for the Foreign and Commonwealth Office and the Chief Constable of Northamptonshire Police.
The claim arises from the death of Harry Dunn following a collision near RAF Croughton with a car being driven by Anne Sacoolas, an American citizen. The claim seeks to challenge decisions that Mrs Sacoolas enjoyed immunity from the criminal jurisdiction of the State pursuant to the Vienna Convention on Diplomatic Relations.
The Court made orders today (i) declining the family’s application for further disclosure to be made by the Foreign and Commonwealth Office, and (ii) refused permission to rely – as expert evidence – on the reports of a distinguished retired diplomat.
The hearing of the claim for judicial review will take place before a Divisional Court over 2 days in October or November of this year.
