Jason Beer QC and Georgina Wolfe successfully defend South Wales Police in claim for significant damages

Philip Rudall, a solicitor, brought a claim for malicious prosecution, misfeasance in public office and conspiracy to injure against the Chief Constable of South Wales Police and the Crown Prosecution Service.  Proceedings twice terminated in Mr Rudall’s favour: once in 2005 when he was acquitted at Cardiff Crown Court of conspiracy to defraud and perverting the course of justice; and again in 2013 when money laundering charges were dismissed for lack of evidence.  He contended in these proceedings that the police and the CPS were engaged in an improper operation designed to prevent him from practising.  He sought in excess of £1m in damages.  In earlier interlocutory proceedings Mr Justice Phillips struck out significant elements of his claim – see here

On 9 July 2018 a three week trial of the claim commenced in the High Court before Mrs Justice Lambert.  After hearing the opening speech on behalf of the Chief Constable, Mr Rudall abandoned his claim against South Wales Police – consenting to an order dismissing it.  The claim against the CPS, in which Claire Palmer acts for the CPS, continues.
