In a ruling handed down on 31 March 2021 in R(AM) v Chief Constable of West Midlands Police [2021] EWHC 796 (Admin), Steyn J gave guidance on the consultation requirement for civil injunctions against youths under Part 1 of the Anti-social Behaviour, Crime and Policing Act 2014. Steyn J held that upon breach of a civil injunction, there is no requirement on the applicant to consult with the local youth offending team prior to arrest, or prior the respondent’s first appearance in court. It was noted that when an injunction includes a power of arrest, breach proceedings are automatically triggered. Steyn J also considered the use of maps accompanying civil injunctive orders and held that an exclusion zone on map must be clearly delineated.
