Alex Ustych (led by Tom Cross KC) successfully represented the Secretary of State for Justice in a judicial review challenge by Stephen Yaxley-Lennon (‘Tommy Robinson’) to his segregation at HMP Woodhill.
Mr Justice Chamberlain, having considered extensive evidence about the Claimant’s detention conditions and regime, concluded that he was not subject to ‘solitary confinement’, his detention did not (even arguably) amount to degrading treatment contrary to Article 3 ECHR nor was it motivated by discrimination based on his ideology.
