New rules, same rules?

The Employment Tribunal Procedure Rules 2024 SI 2024/1155 come into force on 6 January 2025. They replace the existing rules of procedure set out in Schedule 1 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013.

That said, the new Rules substantially remake the rules set out in Schedule 1 to the 2013 Regulations with just a few minor changes. The majority of the changes made by the Tribunal Rules 2024 entail restructuring to reflect modern drafting practices and improve clarity. Watch out though for the renumbering!

In addition, the procedural rules in national security proceedings set out in Schedule 2 to the 2013 Regulations are remade as Schedule 1 to the Tribunal Rules 2024; and the procedural rules in equal value claims set out in Schedule 3 to the 2013 Regulations are remade as Schedule 2 to the Tribunal Rules 2024.
