Coghlan v Chief Constable of Cheshire Police, Chief Constable of Greater Manchester Police and Director General of the National Crime Agency – Judgment

Four members of chambers successfully appeared for the Defendants in Coghlan v Chief Constable of Cheshire Police, Chief Constable of Greater Manchester Police and Director General of the National Crime Agency. Jeremy Johnson QC and Georgina Wolfe acted for Cheshire Police, Fiona Barton QC for Greater Manchester Police and Russell Fortt for the NCA.

Following the shooting of Stephen Akinyemi by Arran Coghlan in 2010, Mr Coghlan was charged with murder. After forensic evidence came to light suggesting that Mr Coghlan had acted in self-defence, the prosecution offered no evidence. In 2016, the coroner at the inquest (in which Fiona Barton QC, Russell Fortt and Georgina Wolfe also appeared) found that Mr Coghlan had acted in reasonable self-defence. Mr Coghlan brought claims for malicious prosecution against the three Defendants.

Deputy High Court Judge Edward Pepperall QC gave summary judgment for Cheshire Police after finding that Mr Coghlan had no real prospects of establishing that any of the Defendants were his prosecutor. He struck out the claims against Greater Manchester Police and the NCA finding that there was no proper basis for contending that they were the prosecutors.
