Chief Constable of Avon & Somerset Police v Eckland – in the Court of Appeal

25 November 2021

Anne Studd QC and Victoria von Wachter intervened on behalf of the IOPC to seek clarification of the EAT judgment on the correct forum for claims for discrimination by police officers against the IOPC.  The type of actions envisaged were claims against the IOPC limited to their investigatory remit as opposed to making recommendations to an Appropriate Authority or presenting the case in a disciplinary hearing where they may be perceived to be a secondary party under section 111/112 Eq A, the first potentially necessitating a different forum to the other two.
