The misconduct process in relation to the restraint of Sean Rigg will proceed despite the officers attempts to stay proceedings for abuse of process. Anne Studd QC represents the IOPC and argued that the statutory regime permitted the IOPC to make representations in respect of the abuse argument based on inexcusable and culpable delay by the IOPC under the 2004 regime as well as the 2008 regime. The IOPC application was successful.
The hearing is currently underway.
